The Regulation of energy efficiency label


According to the Third, Fourth and Ninth Articles of SASO regulation issued by Royal Decree No. 216 on 06.17.1431,  SASO has issued this regulation which aims to rationalize the consumption of electric energy in order to preserve the national economy as well as reduce consumption to the average consumer, by providing scientific and practical means based on standards, with taking advantage of the international practice in this area, and to set areas of standardization in the service of all interested parties, especially the average consumer who needs a practical, simple and reliable way from a neutral party to be able to compare different electrical products in terms of efficiency in the electric consumption by the label installed on each device, to have the ability to acquire devices with high efficiency in the electric consumption without incurring conformity expenses by testing, or the need to go into the standards technical details, which is handled by (SASO) on his behalf.
 
     ​ The energy efficiency label for electrical appliances is an awareness label for the consumer attached on the electrical appliances such as (air conditioners, refrigerators .... and other) includes clarification of the appliances' performance and efficiency in the electric energy consumption and providing some necessary information before buying in a clear, simple and easy way.

There fore,  it is hoped that the applying of this label will contribute to rationalize the electricity consumption in the Kingdom in general and reduce the consumer's electricity consumption, which leads to reduce the burden of his monthly expenses.

Article (1) Definitions 
The following terms, when they appear in this regulation, indicate the following :

1. SASO :
 Saudi Standards, Metrology and Quality Organization. It is the official  authority concerned to conduct conformity assessment around the Kingdom, responsible  to lay down this regulation and empowered to grant licenses to use the label. 

2.Center :
  Saudi Center for Energy Efficiency - King Abdulaziz City for Science and Technology.

3.Products :
 The final electrical products, which the Board of Directors decides to implement this regulation on, such as (air conditioners, refrigerators, freezers ,washing machines ... and other appliances consuming electrical energy).

4.Label :
  A label posted on products which indicates the efficiency of electrical appliances in the consumption of electric energy according to the model described by the Saudi specifications standard of the product, or any other standard specification set by SASO.
  
5.Model :
It is one special number used as a reference for each product which is granted the  license to use the label.

6.Organization :
 Any entity with a legal status that produces, imports or assesses any of the products which lay under this regulation, or any authorized body on its behalf.

7.Related Regulations :
Regulations approved by the Kingdom or SASO's Board of Directors to fight fraud, deception, delusion or misuse of the license, or regulations governing the trade of products or any other regulations.

8.Accredited Laboratory : 
SASO's laboratories or any other laboratory in K.S.A (accredited by the Saudi Accreditation Committee - SAC), or any laboratory abroad (accredited by an accreditation body with full membership in the International Laboratory Accreditation Cooperation- ILAC), or a body that has signed a conformity certificates recognition program with SASO to grant conformity certificates (such body shall be authorized to conduct required assessment and shall be registered in SASO).

9.Test Report :
 A test  report issued by an accredited laboratory. Not more than six months shall pass from the date of its issue when applying for the license.

Article (2) Procedures to register an accredited laboratory at SASO
 An accredited  laboratory, which desires to register for the issuance of  assessment reports related to energy efficiency label, shall follow the following procedures : -
1. Apply for the registration of the laboratory in SASO for the period of two years.
2. Attach a laboratory accreditation certificate in the field of the tests related to the license application for obtaining a label.
3.SASO,under the registration procedures, shall have the right to perform the following:
     A.  Evaluate and inspect the laboratory, including access to conduct some tests..
    B. Request testing of reference  samples of the product for the purpose of comparing the assessment results. 
    C. Request to update the registration data, two years from the date of the laboratory registration ,or in case of changes in the data provided in the registration application. 

Article (3) Implementation Field
  The implantation of this regulation shall be on organizations that apply to SASO for a license to use the label on appliances that they wish to obtain a license for their use, and in which the conditions for label usage is applicable. 

Article (4) Legal Liability 
The organization shall bear full responsibility for the implementation of the requirements of this regulation. Sanctions of anti-commercial fraud law and/or related laws are applicable, if violating any of the articles of this regulation  is proven.

Article (5) Conditions to obtain energy efficiency label
SASO grants the license to use the label for the interested organization, with the following conditions :
1. Organization should be officially registered in the Ministry of Commerce and Industry, and authorized to deal with such activities in line with Saudi Arabia regulations, or it should be registered in SASO.
2. The product should be conformable with Saudi standards, as well as label standards.
3. When The Organization applies for the license, it should provide any data required by SASO for the product that is the subject of the label, and facilitate the task of obtaining a model sample to verify its compliance with the standards, at their own expense.
4.   The Organization undertakes that all data provided to SASO are correct and under its responsibility, and providing the model to SASO - any of available methods (hard copy or soft copy) -is pledge from the facility to do so.
5. The Organization has to pay the costs of the application to SASO.
6. The use of label is just for products and models described in detail in the license, and shall not be used for any other products or models.

Article ( 6) Procedures for obtaining the license to use the label  
The organization that desire to get the license to use the label should follow the following procedures :
1- Submit a separate application for each model of products to be licensed.
2- Fill the forms attached to the Saudi standard related to the label, and provide any additional documents required by SASO.
3- Attach test reports indicating that the product is complying with the   standard of the product as well as the standard of the label, from an accredited laboratory, and attach a valid copy of the accreditation certificate. . 
4- The organization shall submit a semi-annual report for SASO including the amount of sales in the Kingdom of the registered products and licensed to use the label, while maintaining the confidentiality of such information.

Article ( 7) SASO procedures to grant a license to use the label
SASO  shall follow the following procedures to grant  a license to use the label :
1- Study the request submitted and test results, and compare them to the related standard.
2- Write to inform the organization in case of refusal to grant the license to use the label, with a clarification of the reasons.  
3- Grant the license to use the label in the case of the completion of all required procedures. 

Article ( 8) The costs of granting the license to use the label
1- The organization affirms to pay the actual costs required for granting the license procedures determined by the Board of Directors of SASO.
2- SASO has the right to withdraw samples from random consignments of imported products, or locally manufactured and test them in a certified laboratory. The organization shall bear the cost of withdrawing of the samples and the test.

Article (9) General Provisions
1- The organization may submit a new application after the reasons of rejecting the application disappeared, after making the necessary corrections for the reasons led to that, and paying any additional costs approved by SASO. 
2- The organization shall have the right to use the label in the advertisements of the licensed products in various media during the period of validity of the license and in accordance with the contents of the license. The organization is not entitled to use the label in the advertisements after the license is expired.
3- SASO shall study the received complaints regarding the products that have the license to use the label, check their authenticity, and take formal and legal procedures in the case of any evidence of violation. 
4- SASO has the right to cancel the license to use the label if the licensed organization violates the articles of this regulation, and take the formal and legal procedures to ensure the preservation of the rights of SASO.
5- Penalties in accordance with the relevant regulations are applied, for who commits the following: -
(A) Using the label at any of the products or models without obtaining a license from SASO.
(B) Continuing to use the label on any of the products or models after the issuance of the decision to cancel its license, or the license period expired without renewal.
( C) Continuing to cast, publish or advertise in any means of the media about the use of the label for products of which the license is canceled without renewal.
(D) Removing the label affixed to the product, tampering with, or hiding from the consumer during offer for sale of the product.
6-SASO has the right (or its representative) for monitoring of the products obtained the label in the markets, and making sure of the correct application of the instructions contained in this Regulation.
7- The license validity to use the label is one year, and when any amendments (with the exception of formal amendments such as color) applied on the product during the license period, the license for this product will be invalid, and a new application must be submitted to gain a license.
8- Only SASO has the right to interpret the articles of this regulation, and all beneficiaries of the application of this Regulation should comply with interpretations issued by SASO.
